  • The place of worship implements the religious freedom guaranteed by art. 19 Cost. and 9 ECHR. It falls within the legal competence of the regional and local government. The rules on subsidies, town planning, and change of urban destination sometimes apply differences between religious organization with violation of individual freedom. The Italian Constitutional Court and Administrative Tribunals, since 1993, have adopted many judgments on these rules with increasing favor for religious freedom and the place of worship; a development supported by the case law of the ECHR
