  Comentario sobre dos Autos de la Audiencia Provincial de Madrid, Sección 20ª de 13 de octubre de 2020. Criterios aplicados por la doctrina jurisprudencial sobre la posibilidad de iniciar un segundo procedimiento ejecutivo sobre la base del mismo título. Pese a que la jurisprudencia discrepa sobre el alcance y efectos del art. 552.3 LEC, la denominada doctrina flexible -que es la aplicada por las dos Resoluciones que son objeto de comentario- se inclina por admitir el segundo despacho de ejecución si el ejecutante subsana los defectos apreciados en la primera ejecución al presentar su nueva demanda ejecutiva. Todo ello, sin necesidad de acudir a un nuevo procedimiento declarativo.

  Commentary on two Orders of the 20th Provincial Court of Appeal of Madrid of 13 October 2020. Criteria laid down by the Spanish Rulings on the possibility of initiating a second enforcement proceeding of a judgment. Although the Spanish Rulings disagree with respect to the scope and effects of the Article 552.3 of the Spanish Code of Civil Procedure, the criteria applied by the flexible view -which is also applied by the two Orders that are the subject of this Commentary- is to admit a second enforcement proceeding of a judgment if the claimant remedies the defects noted in the first enforcement proceeding when filing the second enforcement claim. All of the foregoing, without the need to initiate a new ordinary civil procedure.
