    A decir de algunos doctrinarios el concepto jurídico del Interés Superior del Niño es un concepto jurídico indeterminado, en este artículo se analiza este término desde una perspectiva socio – jurídica, argumentando en todo momento que la sociedad debe involucrarse en el cuidado de la niñez, en los entornos sociales que están fuertemente enlazados de la sociedad para con la familia, para poder comprender el sentido que la comunidad internacional le ha dado al concepto de niño, menor de edad y familia, de esta manera los tratados internacionales firmados por México y ratificados por el senado generan en el Orden Jurídico Nacional un abanico de normas jurídicas que emanan del texto constitucional para proteger, educar y respaldar los Derechos que le otorga y reconoce la supremacía constitucional a la par de los tratados internacionales a la niñez mexicana.

    According to some doctrinaires, the legal concept of the Best Interest of the Child is an undetermined legal concept, in this article this term is analyzed from a socio-legal perspective, arguing at all times that society should be involved in the care of children, in the social environments that are strongly linked from society to the family, in order to understand the meaning that the international community has given to the concept of child, minor and family, in this way the international treaties signed by Mexico and ratified by The Senate generates in the National Legal Order a range of legal norms that emanate from the constitutional text to protect, educate and support the Rights that are granted and recognize constitutional supremacy along with international treaties for Mexican children.
