    Resulta de vital y trascendental importancia en el estudio del derecho constitucional actual, así como de la teoría jurídica, ocuparse del análisis del precedente judicial y de la capacidad que este tiene de crear subreglas con carácter vinculante y oponible a los jueces y usuarios de la administración de justicia. Trataremos no solo de desarrollar la naturaleza de dichas subreglas, sino también de mirar la ubicación que ocupan dentro del ordenamiento jurídico. Concluiremos, con meridiano acierto, que determinando la ubicación que dichos precedentes ostenten en el escalonamiento jurídico colombiano será así mismo el poder y carácter vinculante que tengan dentro del sistema normativo.

    It is of vital and transcendental importance in the study of current constitutional law, as well as legal theory, to deal with the analysis of the judicial precedent and its capacity to create binding sub-rules that are enforceable against the judges and users of the administration. of Justice. We will try not only to develop the nature of these sub-rules, but also to look at the position they occupy within the legal system. We will conclude, with perfect success, that determining the location that said precedents have in the Colombian legal staging will also be the power and binding nature that they have within the regulatory system.
