Resumen de Convencionalidad de las garantías judiciales y protección judicial en la jurisprudencia de la corte interamericana de derechos humanos sobre Colombia

  El presente artículo de investigación orbita alrededor de la pregunta ¿cuál es el panorama del Estado colombiano frente a las garantías y protección judicial contenidos en la Convención Americana de Derechos Humanos?, teniendo como objetivo general determinar la aplicación de los artículos 8 y 25 de la Convención Americana de Derechos Humanos (la Convención) por parte del Estado Colombiano. Como metodología de investigación es preciso indicar que posee un enfoque jurídico-teórico; utilizando el tipo de investigación descriptivo; método deductivo, analítico y posteriormente aplicando la síntesis; como fuente primaria de investigación se utiliza la Convención y la jurisprudencia de la Corte Interamericana de Derechos Humanos (CorteIDH); como técnica se realiza el análisis de contenido jurisprudencial y finalmente, como instrumento se utilizan fichas de análisis jurisprudencial.

  The present article of investigation orbits around the question: what is the panorama of the Colombian State facing the guarantees and judicial protection contained in the American Convention on Human Rights?  having as a general objective to determine the application of Articles 8 and 25 of the American Convention on Human Rights by the Colombian State. As a research methodology it is necessary to indicate that it has a legal-theoretical approach; using descriptive research type; deductive, analytical method and subsequently applying the synthesis; As the primary source of investigation is the jurisprudence of the Inter-American Court of Human Rights; as a technique, the analysis of jurisprudential content is carried out; and finally, as an instrument, jurisprudential analysis sheets are used
