Resumen de Sanciones por incumplimiento del RGPD en la Unión Europea

El Reglamento General de Protección de Datos de la Unión Europea («RGPD») es de obligado cumplimiento desde el 25 de mayo de 2018, hace ya más de un año. Con la perspectiva del tiempo podemos constatar que los supervisores europeos, en general, han concedido un «plazo de gracia» para que las empresas se adaptaran a la nueva normativa, sin imponer sanciones de multa hasta bien pasados varios meses desde aquella fecha inicial. Durante el año 2019, sin embargo, veintidós reguladores europeos han impuesto ya sanciones económicas por incumplimiento del RGPD. En este estudio se analizan de forma exhaustiva las sanciones impuestas en Europa, con especial atención al motivo de la sanción. Este acercamiento nos permitirá identificar cuáles son los aspectos a los que los supervisores están prestando más atención y que, por tanto, son los que deberán ser objeto de mayor cuidado por parte de los operadores económicos que tratan datos personales.

The General Data Protection Regulation of the European Union («GDPR») is obligatory since May 25, 2018, already more than one year ago. With the perspective of time, we can see that the European supervisors, in general, have granted a «grace period» for the companies to adapt to the new Regulation, and have not imposed any fines until a few months had passed since that initial date. However, during 2019, twenty two European data protection supervisors have imposed economic sanctions for the infringement of the GDPR. In this paper, the fines imposed in Europe have been analyzed exhaustively, with a special focus on the reasons of the fine. This approach shall give us a view on what are the aspects that the supervisors are focusing on and which are therefore those which should be dealt with more carefully on the side of the economic operators who process personal data.
