Recientemente ha entrado en vigor en España el Impuesto sobre Determinados Servicios Digitales, que nace con la finalidad de sujetar a imposición a las multinacionales a cuyo objeto es intrínseca la digitalidad, que operan en territorio español. Sin embargo, su configuración como impuesto indirecto crea dudas sobre qué es lo que se quiere gravar y a quién. El presente trabajo analiza las características de este nuevo impuesto, más allá del nomen iuris dado por el legislador, lo que permitirá concluir sobre si se cumplen o no con las obligaciones impositivas que derivan de los acuerdos internacionales suscritos por el Estado español.
Tax on Certain Digital Services has recently come into force in Spain. It was created with the objective of taxing digital multinationals operating in the Spanish territory. However, its configuration as an indirect tax, raise doubts about which is really going to be taxed and about its compatibility with the Doble Tax Conventions signed by the State. This paper analyzes the features of the tax, without taking into account the nomen iuris given by the legislator and, consequently, the possible violation of the international obligations.
