Resumen de La operación “LAVA JATO” y el proceso político en Brasil: ¿Lucha contra la corrupción o interferencias sistémicas?

El conjunto de investigaciones y operaciones que con la denominación Operação Lava Jato (Operación túnel de lavado) llevado a cabo en Brasil en los últimos años, culminó con el ingreso en prisión del expresidente Luiz Inácio Lula da Silva. La situación política creada, con el empeachment de la presidenta Dilma Rouseff, y el nombramiento de su vice-Presidente Michel Temer como Presidente, propició el escenario para el triunfo del presidente Jair Bolsonaro. A partir de los supuestos sobre el código sistémico “poder-no poder”, y la autonomía de los poderes (Ejecutivo, Legislativo, Judicial), el objetivo de este trabajo es describir e identificar estos procesos en el plano de análisis de las comunicaciones entre los sistemas político-administrativo y el jurídico. Como conclusiones formulamos la hipótesis sobre la limitada autonomía entre los poderes y los límites porosos entre ellos, como causa que frena un combate efectivo a la corrupción.

The set of investigations and operations that under the name Operação Lava Jato (Operation Car Wash) carried out in Brazil in recent years, culminated in the imprisonment of former President Luiz Inácio Lula da Silva. The political situation created, with the impeachment of President Dilma Rouseff, and the appointment of her Vice-President Michel Temer as President, set the stage for the triumph of President Jair Bolsonaro. Based on the assumptions about the systemic code “power-not power”, and the autonomy of the powers (Executive, Legislative, Judicial), the objective of this work is to describe and identify these processes in the analysis plane of communications between the political-administrative and legal systems. As conclusions, we formulate the hypothesis about the limited autonomy between the powers and the porous limits between them, as a cause that stops an effective fight against corruption.
