Resumen de La condena en costas a favor del consumidor

El presente artículo analiza el régimen de la condena en costas cuando el consumidor acude ante los tribunales civiles, así como si procede la aplicación del criterio del vencimiento, incluso cuando este ha visto desestimadas parcialmente sus pretensiones. Para ello se analiza la jurisprudencia española y la reciente STJUE de 16 de julio de 2020; al tiempo que nos aventuramos a analizar cuál podría ser el sentido del fallo que resuelva el Recurso de Inconstitucionalidad Núm. 1960/2017, admitido a trámite contra el RDL 1/2017, de 20 de enero, de medidas urgentes de protección de consumidores en materia de cláusulas suelo.

This article analyzes the regime of the sentence in costs when the consumer goes to the civil courts, as well as if the application of the criterion of the expiration is appropriate, even when this has seen its claims partially rejected. To do this, we analyze the spanish jurisprudence and the recent JCJEU of July 16, 2020; at the same time we venture to analyze what could be the meaning of the ruling that resolves the unconstitutionality appeal n.o 1960/2017, admitted for processing against RDL 1/2017, of urgent consumer protection measures in floor clauses.
