    El artículo aborda el concepto de «libertad de creación artística» y de los límites que deberían aplicarse a las concretas manifestaciones artísticas a raíz de diversos casos objeto de enjuiciamiento por parte de nuestros tribunales, referidos a composiciones musicales, actuaciones de humoristas o exposiciones de arte contemporáneo. También se hace referencia a una posible reforma legislativa que afectaría a diversas disposiciones normativas, esencialmente en lo que refiere al tratamiento penal de actuaciones en el ejercicio de la libertad de expresión y de creación artística. El objetivo de este texto es intentar aportar cierta luz a esta problemática, atendiendo primero al origen histórico-jurídico de la libertad de creación artística —como derivada de la genérica libertad de expresión— y su encaje constitucional sustantivo en nuestro ordenamiento jurídico positivo nacional e internacional.

    The article discusses the concept of "freedom of artistic creation" and the limits that should be applied to specific artistic manifestations in the light of various cases brought before our courts involving musical compositions, performances by comedians or contemporary art exhibitions. Reference is also made to a possible legislative reform that would affect various regulatory provisions, essentially concerning the criminal treatment of actions in the exercise of freedom of expression and artistic creation. The aim of this text is to try to shed some light on this problem, by first looking at the historical-legal origin of the freedom of artistic creation - as a derivative of the generic freedom of expression - and its substantive constitutional place in our national and international positive legal system.
