Reflecting the country’s legal history, the 2002 Brazilian Civil Code is one of the few civil codes in the world with a General Part, heritage of the influence of German authors, and a comprehensive regulation of “juridical acts” and “juridical facts”, both fundamental legal concepts for private lawyers. As there is a renewed interest among French scholars for these concepts, recently enshrined in the French Civil Code, this paper addresses the origins of the distinction made between “juridical acts” and “juridical facts” and sheds some light on the profound diferences between their meaning under French, German and Brazilian law.
Reflexo da história política e jurídica do País, o Código Civil brasileiro de 2002 se caracteriza pela existência de uma parte geral, herdada da doutrina alemã, e pela importância da teoria do fato jurídico como figura estruturante do direito privado. Em razão da recente adoção dos conceitos de acte juridique e fait juridique no Código Civil francês, essas noções no Direito brasileiro suscitam um interesse especial. Nesse sentido, este artigo aborda as origens da concepção brasileira da teoria do fato jurídico, além de demonstrar distinções e semelhanças no Brasil, na França e na Alemanha.
