Resumen de Garantia e responsabilidade patrimonial: novos meios executivos e a execução forçada como reforço da obrigação

This paper analyzes the general guarantee of civil obligations, understood as an intrinsic element of these obligations, as well as its transformation in the last decades due to case law and statutory law changes. It also clarifies the distinction between guarantee, personal liability, enforceability and judicial executory ways. The paper also analyzes the effects of the Brazilian procedural statutory reform, special statutes and, specifically, the Brazilian Code of Civil Procedure on the Law of Obligations.

O artigo trata sobre a garantia das obrigações como elemento do vínculo obrigacional, assim como sua transformação em razão de alterações legislativas e jurisprudenciais nas últimas décadas, bem como faz a distinção entre garantia e responsabilidade patrimonial, execução forçada e meios executivos. Este texto também analisa as reformas processuais, outras leis especiais e, particularmente, o Código de Processo Civil vigente como alteração legislativa com efeito sobre o Direito das Obrigações.
