Resumen de A Teoria do Fato Jurídico e o Sistema de ciência positiva do Direito de Pontes de Miranda: considerações e atualizações filosóficas

This article has as problematic the following questioning: are the philosophical foundations of the Theory of Legal Fact and the Positive Science System of Pontes de Miranda still sufficient to represent an objective reality? In order to satisfy this question, the first topic aims to describe the fundamentals of these theoretical premises to point out, in the second topic, what their problems are, updating it in the guidelines of the philosophy of mind and the philosophy of language. In the end, the unintelligibility of the bridge propositions is verified according to seven indicated inferences, among them the metaphysical existence of the legal world. To support this argument, the integrated research method and the deductive method are used.

O presente artigo tem como problemática o seguinte questionamento: os fundamentos filosóficos da Teoria do Fato Jurídico e do Sistema de Ciência Positiva de Pontes de Miranda ainda são suficientes para representar uma realidade objetiva? Para satisfação desse questionamento, o primeiro tópico tem como objetivo descrever os fundamentos dessas premissas teóricas para apontar, no segundo tópico, quais os seus problemas, atualizando-a nas diretrizes da filosofia da mente e da filosofia da linguagem. Ao final, verifica-se a ininteligibilidade das proposições ponteanas conforme sete inferências indicadas, entre elas a existência metafísica do mundo jurídico. Para subsidiar a presente argumentação utiliza-se o método de pesquisa integrada e o método dedutivo.
