El contexto cultural, económico, social y jurídico del siglo XIX fue decisivo para el diseño de la cláusula Martens en la redacción contenida en el Preámbulo de la II Convención de La Haya sobre las leyes y costumbres de la guerra y su anexo del 29 de julio de 1899. Diferentes actores con diferentes intereses y poderes, expresaron varios puntos de vista sobre la guerra, la ocupación beligerante, la necesidad militar y la humanidad. Estos, a su vez, fueron los asuntos que dieron lugar a la cláusula Martens. El artículo intenta analizar cómo el contexto y los actores, con sus diferentes poderes, impactaron la cláusula de Martens como constante en ese Preámbulo.

The cultural, economic, social and legal environment of the XIX century was a critical key factor for the Martens Clause as enshrined in the Preamble of the II Convention with respect to the Laws and Customs of War on Land and its annexe: Regulations concerning the Laws and Customs of War on Land. Signed at The Hague, of the 29 July 1899. Indeed, several actors with its interests and powers expressed different views related to war, belligerent occupation, military necessity, and humanity. These were indeed the grounding issues, which lead to debates of great importance for the birth of the Martens Clause. This article seeks, therefore, to analyse how the background, several actors with its powers had a profound impact on the Martens clause conception and its final wording.
