Resumen de La garantía jurisdiccional de audiencia en un debido proceso civil cubano

Las garantías constitucionales desempeñan una importante función en el equilibrio y sostenimiento del orden constitucional. De ahí que su ámbito de protección no solo sea la supremacía de la norma sino también los derechos regulados en el texto constitucional, tradicionalmente identificado con la principal función de estos mecanismos protectores. Este artículo de investigación logra delimitar los principales postulados teóricos, normativos y de derecho comparado en torno a la construcción jurídica de la audiencia como una garantía jurisdiccional y contenido del debido proceso, dada su eficacia transversal. Al mismo tiempo que se diagnostican las principales contradicciones normativas en torno a su actual materialización. Se proponen pautas teóricas para el reconocimiento de la garantía constitucional de audiencia y su adecuado ejercicio en el contenido de un debido proceso civil en Cuba.

Constitutional guarantees play an important role in balancing and sustaining the constitutional order. Hence, its scope of protection is not only the supremacy of the norm but also the rights regulated in the constitutional text, traditionally identified with the main function of these protective mechanisms. The research manages to delimit the main theoretical, normative and comparative law postulates around the legal construction of the hearing as a jurisdictional guarantee and content of due process, given its transversal effectiveness. At the same time that the main normative contradictions around its current regulation are diagnosed.
Theoretical guidelines are proposed for the recognition of the constitutional guarantee of hearing and its proper exercise in the content of a civil due process in Cuba.
