Los hechos acontecidos en el Estado de Myanmar sobre la población rohinyá en la última década han sido motivo de investigación y análisis de las sedes judiciales internacionales: Tribunal Internacional de Justicia y Corte Penal Internacional. Tras las oportunas investigaciones de Naciones Unidas y organizaciones internacionales se han alzado sospechas de la comisión de crímenes de lesa humanidad y genocidio. El presente artículo aborda la cuestión rohinyá, sus antecedentes en el Estado de Myanmar, la vulneración sufrida en materia de derechos humanos y revisa la situación jurídica en la que se encuentran los procesos judiciales iniciados en la Corte Penal Internacional y Tribunal Internacional de Justicia. Por último, estudia y defiende la calificación jurídica de delito de genocidio cometido por el Estado de Myanmar.

The events suffered by the Rohingya’s minority in the aftermath of Myanmar’s mobilisation along the last decade have caused the due investigation by the international judicial courts. As the UN Facts finding reports coupled with others have stated, it seems plausible the suspicion of actual crimes of genocide and against humanity being committed. This document analyses the rohingya’s case, its background in Myanmar, the violation in the realm of Human Rights and reviews the current state of judicial processes arranged in both the International Criminal Court and International Court of Justice.
Finally, it offers and defends a statement of crime of genocide committed by Myanmar.
