  This article aimed to examine the transformations in the role of children and ad-olescents in the family and to analyze the institute of shared custody from the perspective of the doctrine of integral protection. Wesought to answer to what extent the best interest of children and adolescents can influence the custody regime and the routine of parents who divorce. For that, the applied methodology was qualitative and theoretical, since bibliographical references of books, periodical articles from the areas of law, psychology and sociology were explored, as well as news about the theme, while the method used will be the hypothetical-deductive. In the first topic, the process of transforming the place in children and adolescents within the family was presented. Subsequently, the progress of Brazilian legislation on child protection was ex-posed. Finally, the shared custody legal institute was shown as an instrument to enforce the rights of the child. In the end, it is concluded that the shared custody is nothing more than the reflection of a long trajectory of changing the understanding we have about childhood, notably in its place in the family, which was previously located on the periphery.

  O presente artigo objetivou examinar as transformações do papel da criança e do adolescente na família e analisar o instituto da guarda compartilhada na perspectiva da Doutrina da Proteção Integral. Buscou-se responder em que medida o melhor interesse de crianças e adolescentes pode influenciar o regime de guarda e a rotina de pais que se divorciam. Para tanto, a metodologia aplicada foi qualitativa e teórica, uma vez que foram exploradas referências bibliográficas de livros, artigos periódicos das áreas do direito, psicologia e sociologia, enquanto o método utilizado será o hipotético-dedutivo. No primeiro tópico, apresentou-se o processo de transformação do lugar na criança e do adolescente no seio familiar. Posteriormente, foi exposto o avanço da legislação brasileira em matéria de proteção à infância. Por último, exibiu-se o instituto jurídico da guarda compartilhada como instrumento de efetivação dos direitos de crianças e adolescentes. Conclui-se que a guarda compartilhada nada mais é que o reflexo de uma longa trajetória de mudança do entendimento que se tem sobre a infância, notadamente no seu lugar na família, que antes era localizado à periferia desta.
