Este artículo analiza la idoneidad de las empresas de gestión de activos ( asset management companies-AMC) como estrategia de gestión de prestamos dudosos ( Non-Performing Loans-NPLs). Primero, analizamos los argumentos a favor de las AMCs en el contexto europeo, incluida la experiencia nacional de Irlanda (NAMA), España (SAREB), Eslovenia (DUTB), Hungría (MARK) e Italia,pre-y post-AMCO.Luego, analizamos los problemas de las AMC, como el riesgo de que oculten subvenciones a la industria, o estrategias de recuperación socialmente dañinas. Después, exploramos el diseño de las AMC, incluida su naturaleza centralizada/descentralizada y pública/privada, así como la estructura de sus activos y pasivos. Entre otras conclusiones, abogamos por prestar más atención a la realción entre la dimensión financiera y social de los NPL (y los AMC), y sobre las complementariedades entre los AMC y la titulización.
This article examines the suitability of asset management companies (AMC) as a management strategy for non-performing loans (NPLs). First, we analyze the arguments in favor of AMCs in the European context, including the national experience of Ireland (NAMA), Spain (SAREB), Slovenia (DUTB) Hungary (MARK) and Italy, pre- and post-AMCO. Then we look at the problems of AMCs, such as the risk of them hiding subsidies to the industry, or socially damaging recovery strategies. Next, we explore the design of AMCs, including their centralized / decentralized and public / private nature, as well as the structure of their assets and liabilities. Among other conclusions, we advocate for a closer attention to the relationship between NPLs’ (and AMCs’) financial and social dimension, and to the complementarities between AMCs and securitization.
