    La investigación analiza la figura de las criptomonedas en el marco de la teoría del patrimonio desde la doctrinaria comparada. Se trata de un estudio transversal que aborda esta figura jurídica bajo los postulados fundamentales que en el Derecho Civil se han construido sobre una de las instituciones más tradicionales como lo es el patrimonio, todo lo cual refleja diversas consecuencias jurídicas en distintos escenarios globales. Se parte de las nociones básicas sobre criptomonedas y patrimonio para pasar a una caracterización común de las criptomonedas, analizando su naturaleza jurídica para luego vincularlas con las teorías del patrimonio, los sujetos involucrados en sus operaciones, así como sus obligaciones. Todo esto, así como su adquisición, permite analizar el derecho de propiedad sobre las criptomonedas y su relación patrimonial con la naturaleza del dinero finalizando con las implicaciones de la opacidad de las operaciones.

    The research analyzes the figure of cryptocurrencies inside the theory of the patrimony according to the compared doctrine. It is a transversal study that addresses this legal figure under the fundamental postulates that in Civil Law have been built on one of the most traditional institutions such as the patrimony, all of which reflects various legal consequences in different global settings. It starts from the basic notions about cryptocurrencies and patrimony to move on to a common characterization of cryptocurrencies, analyzing their legal nature and then linking them with the theories of patrimony, the subjects involved in their operations as well as their obligations. All this, as well as its acquisition, allows us to analyze the property rights over cryptocurrencies and their patrimonial relationship with the nature of money, ending with the implications of the opacity of operations.
