El reconocimiento y, sobre todo, la ejecución de resoluciones extranjeras, ya sean laudos arbitrales o sentencias judiciales, en nuestro país, adquiere una dificultad adicional cuando la parte demandada es un Estado soberano, pues exige observar una serie de garantías que permitan respetar la inmunidad del Estado en cuestión. En la práctica, sin embargo, no es tanto la inmunidad del Estado extranjero, sino cuestiones referidas al procedimiento, las que obstaculizan el buen fin de la ejecución y la posibilidad de hacer efectiva la resolución de que se trate. En este artículo abordaremos de manera sucinta y sencilla algunos de esos problemas y, también, las posibles soluciones.
In Spain, the recognition and, especially, the enforcement of foreign judgments, whether arbitral awards or court judgments, can be even more difficult when the defendant is a sovereign state, as a series of guarantees must be observed in order to respect the immunity of the state in question. In practice, however, it is not so much the immunity of the foreign state as procedural issues that hinder the successful completion of enforcement and the ability to enforce the judgement in question. In this article, we will address some of these problems and possible solutions in a succinct and simple manner.
