    The article analyses in a problematic key the perspectives linked to the use of predictive algorithms to assess social dangerousness (as risk assessment tools), in the awareness of the advantages that can derive from an evidence-based assessment system, on the one hand, and of the risks for the protection of fundamental rights, on the other; can the algorithm represent an expert testimony, submitted to the judge by adopting the "Daubert" criteria?

    Il lavoro analizza in chiave problematica le prospettive legate all’utilizzo di algoritmi predittivi per valutare la pericolosità sociale, nella consapevolezza dei vantaggi che possono derivare da un sistema di accertamento evidence – based, da una parte, e dei rischi per la tutela dei diritti fondamentali, dall’altra;

    l’algoritmo può rappresentare una perizia, sottoposta al vaglio del giudice adottando i criteri “Daubert”?
