El presente trabajo plantea los términos del debate sobre una de las cuestiones en las que nuestra reciente jurisprudencia constitucional muestra una de sus peores facetas. En una sociedad dominada por el furor punitivo y con un legislador que actúa a golpe de tweet, castigar conductas que no generan riesgo alguno ni producen una incitación indirecta al delito puede suponer el golpe definitivo para la libertad de expresión, muy tocada ya por el enorme efecto de desaliento al que nos aboca la interpretación del Tribunal Constitucional. Una interpretación difícilmente compatible con la jurisprudencia del tedh. En este escenario, suficientemente polémico y discutible, nace la propuesta del Grupo Parlamentario Socialista que pretende reformar el cp para que la apología y exaltación del franquismo sean delito. El legislador pretende ahora perseguir y penalizar determinados discursos políticos, como los que exaltan o pueden considerarse apología del franquismo, por lo que resulta conveniente recordar ciertas líneas rojas ex constitutione.

This paper sets out the terms of the debate on one of the issues in which our recent constitu-tional jurisprudence shows one of its worst achievements. In a society both dominated by punitive rage and a legislator who acts at the stroke of a tweet, punishing behaviours that do not generate any risk or produce an indirect incitement to crime can be the final blow to freedom of expression, already very tou-ched by the enormous chilling effect to which the interpretation of the Constitutional Court leads us. An interpretation that is hardly suitable with the case law of the echr. In this scenario, sufficiently controversial and debatable, is born the proposal of the Socialist Parliamentary Group that aims to reform the Spanish Criminal Code so that the apology and exaltation of Franco dictatorial regime are a crime. The legislator now intends to prosecute and penalize certain political speeches, such as those that exalt or can be con-sidered as an apology of previous dictatorial regimes, so it is convenient to remember certain red lines ex constitutione.
