Resumen de O processo estrutural como garantia de implementação de mudanças sociais

  The study aims to outline the main points of the structural process and analyze its effectiveness in complying with judicial decisions. The broad participation of society - a really adequate representation, based on an argumentative and dialogical activity, in total consonance with the due constitutional process, is an important measure for the realization of fundamental rights and democratic legitimation of the judicial activity, evidencing, therefore, the need of the process to be rethought. To this end, the research will analyze the relevant aspects of the Brazilian procedural system in the face of multipolar disputes and whether this system is sufficient to welcome the structural process, especially regarding the analysis of dialogicity as a factor for legitimizing a fair and democratic process. The Structural Process will also be investigated through a brief historical incursion.

  O estudo visa delinear os principais pontos do processo estrutural e analisar a sua eficácia no cumprimento das decisões judiciais. A ampla participação da sociedade - uma representação realmente adequada, baseada em uma atividade argumentativa e dialógica, em total consonância com o devido processo constitucional, é uma medida importante para a efetivação dos direitos fundamentais e a legitimação democrática da atividade judiciária, evidenciando, portanto, a necessidade do processo ser repensado. Para tanto, a pesquisa analisará os aspectos relevantes do sistema processual brasileiro diante das controvérsias multipolares e se esse sistema é suficiente para acolher o processo estrutural, especialmente no que se refere à análise da dialogicidade como fator de legitimação de um processo justo e democrático. O Processo Estrutural também será investigado por meio de uma breve incursão histórica.
