Resumen de O direito e a justiça na contemporaneidade sob o olhar da hermenêutica jurídica

  This article proposes to analyze the relationship between law and justice from the perspective of legal hermeneutic criticism, envisioning in this way to minimize possible injustices resulting from the application of the law or even as an indication of omissions in the legislative system. Demonstrating the importance of Law as a promoter of Justice in favor of the defense of dignified life, the investigation of Justice and Law is under the focus of the legal hermeneutic criticism that acts to understand the importance of law for human life, a true safeguard against unconstitutional norms that generate injustice. The present research face the question about the ineffectiveness of the norms, which tolerate the person’s right to dignity, generating social inequality. For this, as a methodological path for the development of the work, the hypothetical deductive method is used and as a procedure the theoretical deepening through bibliographical research in legal and philosophical books and in the available databases.

  O presente artigo busca analisar a relação entre o direito e Justiça sob o enfoque da crítica hermenêutica jurídica, vislumbrando nesta caminhos para minimizar possíveis injustiças decorrentes da aplicação da lei ou até mesmo como indicativo de omissões do sistema legislativo. Demonstrando a importância do Direito como promotor de Justiça em prol da defesa da vida digna, a investigação da temática se faz sob o olhar da hermenêutica jurídica crítica que atua para a compreensão da importância do direito para a vida humana, verdadeiro atalaia contra normas inconstitucionais que geram a injustiça. A presente pesquisa enfrenta o questionamento sobre a ineficácia das normas, que tolhem da pessoa o direito dignidade, gerando a desigualdade social. Para tanto, como percurso metodológico para o desenvolvimento do trabalho, utiliza-se do método hipotético dedutivo e como procedimento o aprofundamento teórico por meio de pesquisa bibliográfica em livros jurídicos e filosóficos e nas bases de dados disponíveis.
