This paper will demonstrate the importance and the influence of Catholic moral theology and probabilism, one of its most important lines of thought in the 17thcentury, on the performance of judges in Spanish Colonial America, from “Escribanía” and “Justicia” Sections of the Archivo General de Indias (AGI). The ability to choose one of several probable opinions gave the administrators of justice a hermeneutic and freedom of interpretation that allowed them to relativise and adapt the royal laws tothe circumstances of the specific local cases

Este trabalho procurará mostrar a importância da Teologia moral e do probabilismo na atuação dos juízes na América espanhola durante o século XVII, a partir das Secções “Escribanía” e “Justicia” do Archivo General de Indias (AGI). A possibilidade de escolher uma, de entre várias opiniões prováveis, oferecia aos administradores da justiça uma hermenêutica e uma liberdade de interpretação que permitia relativizar e adaptar as leis régias aos limites circunstanciados dos casos locais concretos.
