Resumen de Legalidad y Oportunidad en el ejercicio de la potestad sancionadora en materia ambiental

El presente trabajo tiene por objeto investigar la naturaleza del ejercicio de la potestad sancionadora en materia ambiental. Para ello se propone la tesis de que la Superintendencia del Medio Ambiente goza de un margen de apreciación para determinar si ejerce o no su potestad sancionadora, para lo cual se debe ponderar una serie de criterios o supuestos relacionados con la gravedad de la falta, posibilidad real y costos de la sanción, historial del infractor, entre otros. Esa decisión, sin embargo, puede ser controlada en su razonabilidad por los Tribunales Ambientales. Para esta conclusión se ha realizado una revisión de la cabida de la oportunidad en la regulación ambiental chilena y comparada, junto con análisis de la principal jurisprudencia nacional.

The purpose of this work is to investigate the nature of the exercise of the sanctioning power in environmental matters. The thesis is proposed that the environmental agency has a margin of appreciation to determine whether or not to exercise its sanctioning power. A series of criteria or assumptions related to the severity of the fault, actual possibility and costs must be weighed of the sanction, history of the offender, among others. That decision, however, can be reasonably controlled by the Environmental Courts. For this conclusion, a review of the place of opportunity in Chilean and comparative environmental regulation has been carried out, together with an analysis of the main national jurisprudence.
