Resumen de La sostenibilidad urbana y el derecho a la ciudad: ¿nexo ineludible?

El insuficiente reconocimiento jurídico del derecho a la ciudad limita el pleno alcance de la sostenibilidad urbana. A partir de ello se realiza el presente artículo, en el cual, con el uso de los métodos sociológico, análisis-síntesis, teórico-jurídico y hermenéutico-jurídico, se aborda el tema del derecho a la ciudad desde la relación intrínseca que guarda con la sostenibilidad urbana. En su desarrollo se abordan aspectos relacionados con la sostenibilidad urbana y el derecho a la ciudad, de acuerdo con las concepciones más usuales que se utilizan, sus dimensiones y los indicadores que determinan su presencia, así como las principales limitaciones que actualmente tiene. Asimismo, se valora cuál es la posición que ocupa este tema en las agendas de las principales organizaciones mundiales, regionales y nacionales, además de las principales acciones y respaldo jurídico para coadyuvar a su realización. Se enfatiza en cómo la sostenibilidad urbana deviene en un tema prioritario para los Estados y cómo el reconocimiento jurídico del derecho a la ciudad, puede contribuir a perfeccionarla.

The insufficient legal recognition of the right to the city limits the full scope of urban sustainability. Based on this, the present article is carried out, in which, with the use of sociological, analysis-synthesis, theoretical-legal and hermeneutic-legal methods, the issue of the right to the city is addressed from the relationship intrinsic that keeps with urban sustainability. In its development, aspects related to urban sustainability and the right to the city are addressed, in accordance with the most common concepts that are used, its dimensions and the indicators that determine its presence, as well as the main limitations it currently has. Likewise, the position that this issue occupies in the agendas of the main global, regional and national organizations is valued, as well as the main actions and legal support to assist in its realization. Emphasis is placed on how urban sustainability becomes a priority issue for States and how the legal recognition of the right to the city can contribute to perfecting it.
