    El objeto del presente trabajo es analizar los diferentes medios que, a lo largo de la historia, ha desarrollado el ordenamiento jurídico español para proteger la propiedad industrial. Con la propiedad industrial se trata de proteger las creaciones del intelecto humano encaminadas a fomentar el progreso técnico, que sirven para satisfacer las necesidades humanas y redundan en el desarrollo económico de un país. La protección en nuestro sistema jurídico es doble: mercantil y penal. Aunque en principio la protección penal se considera como la más enérgica y eficaz, sin embargo, en la práctica de hecho es la tutela dispensada por las leyes mercantiles las que suelen elegir las empresas para protegerse contra las infracciones de la propiedad industrial.

    The purpose of this paper is to analyze the different means that, throughout history, the Spanish legal system has developed to protect industrial property. It is about protecting the creations of the human intellect aimed at promoting technical progress with industrial property. It serves to satisfy human needs and result in the economic development of a country. Protection in our legal system is twofold: civil and criminal. Although at first glance criminal protection is considered the most energetic and effective, however, in practice it is the protection provided by commercial laws which companies usually choose to protect themselves against infringements of industrial property.
