    El presente artículo trata sobre los principios de igualdad y no discriminación de las personas en situación de migración irregular. El cuestionamiento y motivación por el estudio de la temática parte de recientes sucesos donde se realizaron deportaciones masivas a personas migrantes irregulares, vulnerando los más elementales principios de la normativa internacional y la nacional en materia de derechos humanos fundamentales. En el trabajo se abordan como puntos principales de análisis: 1- Definición y características del derecho a la igualdad y no discriminación; 2- El contenido esencial y alcance de la igualdad y no discriminación; 3- La igualdad y no discriminación en el Sistema Interamericano de Derechos Humanos; 4- La protección legal del derecho a la igualdad y no discriminación en la Constitución ecuatoriana de 2008 y 5- El hábeas corpus frente a la movilidad humana. Como objetivo central del estudio, se persigue analizar los postulados teórico doctrinales de los principios de igualdad y no discriminación y su aplicación real y efectiva en el Ecuador. La metodología empleada es la cualitativa, donde a través del análisis reflexivo y los puntos de vista de las investigadoras, se llega a conclusiones sobre la temática abordada.

    This article deals with the principles of equality and non-discrimination of persons in a situation of irregular migration. The questioning and motivation for the study of the issue stems from recent events where mass deportations of irregular migrants were carried out, violating the most elementary principles of international and national regulations on fundamental human rights. At work, the main points of analysis are addressed: 1- Definition and characteristics of the right to equality and non-discrimination; 2- The essential content and scope of equality and non-discrimination; 3- Equality and non-discrimination in the Inter-American Human Rights System; 4- The legal protection of the right to equality and non-discrimination in the Ecuadorian Constitution of 2008 and 5- Habeas corpus against human mobility. The main objective of the study is to analyze the theoretical-doctrinal postulates of the principles of equality and non-discrimination and their real and effective application in Ecuador. The methodology used is qualitative, where through reflective analysis and the researchers' points of view, conclusions are reached on the topic addressed.
