Resumen de Decisión 608 de la comunidad andina: Un paso adelante para el sistema antimonopolios de la región

  Es definitivo el impacto positivo que trae la Decisión 608 de la CAN, a diferencia de la 285 que no dejó resultado concreto. Esta nueva decisión trae elementos novedosos que permiten a ese organismo actuar de manera directa en los países miembros a través de investigaciones, imposición de sanciones, hasta instrucción a los gobiernos.

  En este artículo se pretende analizar como puede dársele buen uso a estas nuevas normas; como el Estado, siendo el agente económico más importante no puede quedar de lado en las reglas de competencia que definitivamente no son exclusivas del sector privado. Máxime cuando el intervencionismo impera en la región latinoamericana facilitando así las distorsiones económicas por parte del Estado, y además casi siempre sin sanción alguna.

  Pero es cardinal considerar que necesitamos la constancia y voluntariedad de todos los países miembros para permitir que la CAN, con base a la experiencia europea alcance los objetivos de esta decisión en beneficio de nuestros capitalismos incipientes.

  The positive impact brought by Decision 608 of the Andean Community is unquestionable, unlike Decision 285 that did not produce concrete result. This new Decision brings new elements that allow said organism to act directly on the Members through investigations, imposition of sanctions, and even instruction to the governments.

  This article attempts to analyze how these new norms can be put to good use; how the State, being the most important economic agent, cannot be set aside in the rule of competition, which are definitely not exclusive of the private sector, especially when interventionism reigns in the American Latin region, thereby facilitating economic distortions on the part of the State, and in addition to that, almost always without sanction.

  However, it is essential that we understand the need for all Members to be persevering and determined to allow the Andean Community to attain the objectives of this Decision, based on the European experience, in order to attain the objectives of this Decision in benefit of our incipient Capitalisms.
