  El presente trabajo, tiene como finalidad reflexionar sobre un nuevo medio de tutela de derechos colectivos, a partir del proceso arbitral que se regla en el Real Decreto 231/2008. Asimismo, se efectúan consideraciones sobre los aspectos procesales más adecuados que debe tener un proceso arbitral con la particularidad que, en dicho juicio arbitral, se atenderán conflictos colectivos, y es por ello, que se ofrece al lector, y desde luego, se pone en debate, las contingencias particulares de este medio de tutela.

  The purpose of this work is to reflect on a new means of protection of collective rights, based on the arbitration process established in Royal Decree 231/2008. Likewise, considerations are made on the most appropriate procedural aspects that an arbitration process must have with the particularity that, in said arbitration judgment, collective conflicts will be addressed, and that is why, it is offered to the reader, and of course, it is put into debate, the particular contingencies of this means of guardianship.
