La volontà nella dicatio ad patriam. Considerazioni a margine di una pronuncia recente

    Una recente ordinanza della Corte di cassazione esamina le condizioni di applicabilità della TOSAP alle aree oggetto di dicatio ad patriam. Prendendo avvio da tale pronuncia, il saggio propone un’indagine dell’istituto, volta a evidenziarne le caratteristiche peculiari e a metterne in luce le radici romane. Delineati i tratti della figura nel diritto vigente, vengono dunque analizzati i pertinenti testi del Digesto, e in particolare Ulp. 9 ad ed. D. 41.1.41, Ulp. 71 ad ed. D. 43.24.11.1 e Lab. 6 pith. a Paul. epit. D. 44.1.23, donde emerge come la mens del positor e la volontà di arricchire la collettività costituiscano elementi qualificanti della fattispecie nella riflessione dei giuristi romani. Di conseguenza, se ne auspica conclusivamente una valorizzazione anche in sede giurisprudenziale, in ragione del sicuro nesso genetico esistente tra l’istituto odierno e le fonti antiche.

    A recent ruling of the Court of cassation examines the conditions for the applicability of TOSAP to areas subject to dicatio ad patriam. Moving from this decision, the essay proposes a survey of the institute aimed at highlighting its peculiar characteristics and its Roman roots. After outlining the features of the figure in current law, the relevant texts of the Digest are analysed, with special reference to Ulp. 9 ad ed. D. 41.1.41, Ulp. 71 ad ed. D. 43.24.11.1 and Lab. 6 pith. a Paul. epit. D. 44.1.23. As a result, the article shows how the mens of the positor and the will to enrich the community qualify the dicatio in the thinking of the Roman jurists.

    Consequently, it suggests that they be accepted as essential elements by the courts, in line with the sure genetic link between today’s institution and the ancient sources.
