Resumen de Mendicância, vagabundagem e a defesa do ius migrandi em Domingo de Soto: a atualidade da contribuição da Escola Ibérica da Paz para um problema renovado

  • This article analyzes the contribution of Domingo de Soto in the context of the reform of assistance in the sixteenth century, from the book Deliberación en la causa de los pobres, in which the author discusses the recent legislation of the time that prohibited the begging of foreigners and proposed a secularized model of assistance to the poor. It seeks to emphasize that Soto, outstanding intelligence of the Iberian School of Peace, when engaging in the relevant discussion around the theme, highlights the coherence of the key arguments and characteristics on the aforementioned School, which allows a rather distinct humanist look at its premises and conclusions in relation to the humanist reformers like Erasmus and Vives. This peculiarity allows us to propose, in the end, that the structuring foundations of the discourse of the thinkers of the Iberian School do not establish exclusive demarcation lines between internal and external law, but instead recognize the legal phenomenon as universal and uniform.
