  La cautio damni infecti de Roma fue una medida procesal de carácter preventivo dispuesta por el pretor tendiente a evitar la producción de daños en las relaciones de vecindad. Este Instituto de gran importancia en Roma, operaba al decir de Ulpiano, cuando el daño es inminente y requiere pronto remedio. Es indudable el carácter preventivo que tenía. El Código Civil, con la reforma de la Ley 17711, receptó la cautio damni infecti en su articulado. También el nuevo Código Civil y Comercial recepta esta medida procesal de carácter preventivo, lo cual se explica fácilmente si tenemos en cuenta que este digesto receptó expresamente el principio preventivo, propio del derecho ambiental. Resulta, en consecuencia, la cautio damni infecti, una medida que puede interponerse sin duda alguna en la defensa del ambiente. Una vez más vemos la vigencia de instituciones de Roma en el derecho actual, que permiten afirmar que el derecho romano sigue vivo y no es un mero producto histórico.
