El reclamo de protección legal adecuada para las creaciones culinarias es una realidad cuyo debate vuelve con el auge que ha ganado en los últimos tiempos el sector gastronómico. Sus creadores tratan incansablemente de encontrar un instrumento jurídico que preste tutela suficiente. Para ello se recurre al Derecho de la Propiedad Intelectual. Sin embargo, la realidad práctica muestra el largo camino que queda por recorrer, dadas las dificultades intrínsecas a la naturaleza de estas creaciones del intelecto humano y a sus tres posibles manifestaciones; siendo una de ellas el sabor o la percepción gustativa. En particular, se ha procurado dar cobertura por medio de los derechos de autor, no sin ciertos obstáculos que salvar. Como alternativa se presenta el Derecho de marcas. Sucede, sin embargo, que la conformidad de un instrumento jurídico de tutela deja al descubierto aspectos de la misma creación cuyo amparo todavía se reclama.

The demand for adequate legal protection for culinary creations is a reality whose debate is returning with the boom that the gastronomic sector has gained in recent times. Its creators are tirelessly trying to find a legal instrument that provides sufficient protection. Intellectual Property Law is used for this purpose. However, practical reality shows the long road that remains to be travelled, given the difficulties intrinsic to the nature of these creations of the human intellect and their three possible manifestations, one of them being taste or gustatory perception. In particular, efforts have been made to provide coverage by means of copyright, but not without certain obstacles to overcome. As an alternative, trademark law is presented as an alternative. It happens, however, that the conformity of a legal instrument of protection leaves uncovered aspects of the same creation whose protection is still claimed.
