La Ley Concursal dio en su artículo 52 (hoy artículo 140 del Texto Refundido) un tratamiento específico a la eficacia de los convenios arbitrales en el concurso de acreedores, primeramente, para suspender sus efectos y después, tras la reforma de 2011, para admitir su vigencia a reserva de la apreciación discrecional por el juez del concurso de un «perjuicio para la tramitación» del proceso. El artículo analiza de forma crítica la evolución normativa y sus ambigüedades, a la vez que propugna una relación constructiva entre el concurso y el arbitraje que abandone la desconfianza que parece presidir la actual regulación.
Spanish Insolvency Act Article 52 (now Article 140 of the revised law) granted specific treatment to the validity of arbitration agreements in insolvency proceedings, firstly, to suspend their effects, and later, following the 2011 amendment, to accept their validity subject to a discretionary finding by the insolvency judge of an «adverse effect on the conduct» of the process. The article analyzes critically the evolution of the rule and its ambiguities, at the same time as it proposes a constructive relationship between insolvency and arbitration proceedings, which will leave behind the distrust that appears to inspire the current legal regulation
