Resumen de Member States’ Constitutional Rules on the Withdrawal from the European Union - Spain

  This report studies the legal framework that would apply in Spain in case it were to hypothetically decide to withdraw from the European Union. First, it delves into the constitutional foundations of a hypothetical withdrawal, highlighting the controversies still alive today. Second, the report analyzes the procedure to be followed when denunciating an international treaty. Third, a special focus is put on the possibility to conduct a hypothetical referendum on this matter and the legal effects and controversies arising from the possibility of conducting this type of consultation. Last, this research endeavors to outline the issue of public opinion on the withdrawal from the European Union, signaling whether this matter is a topic of discussion in Spain nowadays, the political parties supporting such withdrawal, and whether civil society in Spain shows feelings of attachment to the EU or supports a move away from the institution.

  Ce rapport étudie le cadre juridique qui s’appliquerait en Espagne dans le cas où elle décidait hypothétiquement de se retirer de l’Union européenne. Premièrement, il approfondit les fondements constitutionnels d’un retrait hypothétique, en mettant en lumière les controverses encore existantes aujourd’hui. Deuxièmement, le rapport analyse la procédure à suivre pour dénoncer un traité international. Troisièmement, un accent particulier est mis sur la possibilité d’organiser un référendum hypothétique sur cette question et sur les effets juridiques et les controverses résultant de la possibilité de mener ce type de consultation. Enfin, cette recherche essaye d’esquisser la question de l’opinion publique sur le retrait de l’Union européenne, en signalant si cela est un sujet de discussion en Espagne aujourd’hui, les partis politiques qui soutiennent ce retrait, et si la société civile en Espagne fait preuve des sentiments d’attachement à l’UE ou si elle soutient un éloignement de cette institution.
