Resumen de Sentido y alcance del contenido esencial del derecho a migrar en Chile

  El aumento de flujos migratorios es una realidad presente en nuestro país que ha implicado que el Estado chileno de respuesta a este fenómeno complejo desde su institucionalidad vigente. En este sentido resulta interesante determinar qué se ha comprendido por derecho a migrar en nuestro país y si esto es acorde a no con el derecho internacional de los derechos humanos.

  Este trabajo tiene por objetivo proponer qué debería comprender el contenido esencial del derecho a migrar en Chile. Para ello se analizarán aspectos doctrinarios y jurisprudenciales referentes al contenido esencial de los derechos, como garantía normativa. A su vez, la normativa nacional e internacional sobre el derecho a migrar.

  Para la construcción de nuestra propuesta se utilizarán los estándares interamericanos, en materia migratoria, que establecen los cimientos mediante los cuales debería construirse este espacio inviolable de este derecho humano.

  The increase in the migration flow has been a fact in our country during the last five years. Because of that the State of Chile has been forced to give an answer to this situation despite of the complexity of this phenomenon within the current institutional law framework.

  In this context is interesting to determine the significance of the right to migrate in our country and if this conception is in line with the international human rights.

  This article has as objective propose which elements should be considered within the essential content of the right to migrate in Chile. To determine these different aspects (doctrinal and jurisprudential issues) were analyzed according to the essential content as a normative guarantee of fundamental rights. Also, within this analysis it was considered the national and international migration law. To build this proposal the Inter-American standards of migrant’s rights were used as a criteria to ensure the accomplishment of this fundamental human right.
