Las Sentencias del Tribunal Constitucional de 15 de junio de 2020 y 15 de febrero de 2021 han ejercido una influencia especialmente visible en las decisiones, posteriores a febrero de 2021, del Tribunal Superior de Justicia de Madrid, que se caracterizó por jugar, en la mayor parte de sus decisiones, el papel de adalid de la teoría partidaria de aplicar una interpretación extensiva del concepto de orden público, a la hora de apreciar su violación como causa de anulación del laudo. Este Tribunal Superior de Justicia adapta ahora sus resoluciones a lo dispuesto en la Sentencias del Tribunal Constitucional antes mencionadas.

The Judgments of the Constitutional Court of June 15, 2020 and February 15, 2021 have had a particularly visible influence on the decisions, subsequent to February 2021, of the High Court of Justice of Madrid, which was characterized by playing, in most of its decisions, the role of champion of the theory in favor of applying an extensive interpretation of the concept of public policy, when assessing its violation as a cause for annulment of the award. This High Court of Justice now adapts its rulings to the provisions of the aforementioned Constitutional Court Judgments.
