La migración en la agenda 2030, el desarrollo en el Pacto de Marrakech: plasmación programática de una inescindible relación

    El inescindible –aunque complejo y en absoluto unívoco- nexo entre migración y desarrollo, de un lado, unido al consenso interestatal sobre la necesidad de una gestión ordenada de la migración, de otro, han marcado una evolución desarrollada en las últimas décadas a nivel global que ha permitido construir los dos consensos internacionales, alcanzados entre los años 2015 y 2018 –Agenda 2030 y Pacto de Marrakech-, que vienen a definir el programa mundial en materia de migración y desarrollo para el futuro. Sin embargo, se echa en falta en dicho esquema un tercer pilar, esencial y además previo y superior, pues establece el marco jurídico vigente, aplicable: los derechos humanos. Ello abre la puerta al peligro que suponen los posibles efectos que tendría el «SDG Washing» en Derecho Migratorio.

    The indivisible –although complex and non-unique– connection between migration and development, on the one hand, together with the common understanding of States on the need to develop orderly and regular migration management, on the other, are the main landmarks on the evolution that occurred during the last decades at the universal level that have allowed the International Community to build two international consensuses, reached between 2015 and 2018 –The 2030 Agenda on Sustainable Development and the Marrakech Global Compact on Migration, respectively–, which define the World Program on Migration and Development for the future. However, a third pillar is missing in the Program, a pillar which is both essential, previous and superior to the other two, because it draws the legal regime in force and applicable to the subject matter: human rights. This absence threatens to open the door to several negative effects that the so-called “SDG Washing” would have on Migration Law.
