Resumen de El veto a la respuesta del legislador a la declaración de inconstitucionalidad de una ley en el marco del ordenamiento constitucional español

  El presente trabajo trata sobre una cuestión de suma importancia para la dogmática constitucional: ¿le está vetado al legislador responder a una declaración de inconstitucionalidad de una ley debidamente pronunciada por el Tribunal Constitucional? Se defiende la existencia de este veto y para ello se analiza el marco en el que se tiene que mover la cuestión. En primer lugar, se aborda la premisa sobre la que debe partir cualquier intento de respuesta a la cuestión planteada: la supremacía de la Constitución española. Seguidamente se exponen las bases en que se asienta el veto a la respuesta del legislador: el modelo de justicia constitucional español y los efectos erga omnes de las sentencias del Tribunal Constitucional. Tras ello se analiza el ámbito del veto, esclareciendo su alcance y sus límites. Por último, se aborda brevemente la eficacia del veto, es decir, la posible existencia de instrumentos que puedan asegurar su realización y, en concreto, la posibilidad de usar el incidente de ejecución de sentencias.

  This paper analayses an extremely important question for the constitutional theory: there is a veto to the legislative overruling of the spanish Constitutional Court judgments? The existence of this veto is defended. With this purpose the framework in which the issue is inserted is analyzed. Firstly, the premise on which any attempt to answer the question should start: the supremacy of the Spanish Constitution. Subsequently, the bases on which the veto to the legislative overruling is based are treated: the Spanish constitutional justice system and the erga omnes effect of the Constitutional Court rulings. After that, the framework of the veto is analyzed, clarifying its extension and limits.

  Finally, the realization of the veto is briefly addressed: the possible existence of instruments that can ensure the veto, and specifically the incident of execution of sentences like a proper mechanism to this purpose.
