    Fundamental rights and constitutionalism have a close bond of affinity. Thus, the emergence of this is essential for the materialization of that. Thus, the delimitation and the study of the objective theme delineate and promote the examination of fundamental rights, as a product of the social function of contemporary constitutional law. The present article aims to examine the theme on constitutionalism in the perspective of fundamental rights. To do so, analyze the historical panorama that justifies these rights, creating a relationship between the institutes. We used bibliographic research, exploratory and descriptive, based on theses, articles and doctrines pertinent to the theme. What was sought was to emphasize the need to interrelate these institutes, to promote the discussion about the theme and also to clarify their nature, their evolution and the philosophical perception.

    Os direitos fundamentais e o constitucionalismo têm um laço estreito de afinidade. Assim, o surgimento deste é essencial para a materialização daquele. Assim, a delimitação e o estudo do tema objetiva delinear e fomentar o exame dos direitos fundamentais, como produto de função social do direito constitucional contemporâneo. O presente artigo tem como objetivo examinar o tema sobre o constitucionalismo na perspectiva dos direitos fundamentais. Para tanto, analise-se o panorama histórico justificador desses direitos, cirando uma relação entre os institutos. Utilizou-se de pesquisa bibliográfica, de caráter exploratório e descritivo, com base em teses, artigos e doutrinas pertinentes ao tema. O que se buscou foi ressaltar a necessidade em inter-relacionar estes institutos, para promover a discussão acerca do tema e, ainda, esclarecer a natureza dos mesmos, sua evolução e a percepção filosófica.
