    EL presente trabajo tiene por objeto analizar una de las cuestiones más problemáticas y discutibles que plantea el delito de abandono del lugar del accidente introducido por LO 2/2019, de 1 de marzo de modificación de la Ley Orgánica 10/1995, de 23 de noviembre, del Código penal. En concreto, este artículo aborda el estudio del bien jurídico protegido en el art. 382 bis, ubicado entre los delitos contra la Seguridad vial, con la finalidad de constatar la existencia de un bien jurídico compatible con el principio de intervención mínima.

    This paper analyses one of the most important and controversial issues raised regarding the crime of abandonment of the scene of an accident, which was incorporated into the Criminal Code by Organic Law 2/2019, March 1st. This study addresses the examination of the legal asset safeguarded set out on article 382 bis. The former legal norm is regulated in the chapter devoted to road safety offences. The aim is to identify if there is a legal interest compatible with the principle of minimum intervention which should be protected.
