Resumen de La adquisición de la propiedad en subasta judicial: momento de transmisión y revisión crítica

  El presente artículo tiene por objeto abordar la fijación del momento a partir del cual se adquiere la propiedad u otro derecho real que implique posesión y sea realizable en sede de subasta judicial, revisando, con espíritu crítico, el estado doctrinal y jurisprudencial de una cuestión poco esclarecida en la actualidad. A tal efecto, se confrontará el modo de adquirir en compraventa privada y subasta pública para concluir con una propuesta unificadora sobre el momento de transmisión en esta última que contribuya a dotar de mayor seguridad jurídica a un fenómeno de tal entidad jurídica e impacto socioeconómico.

  The purpose of the report is to determine the establishment of the moment as from which the property or right in rem is acquired in a judicial public auction. The case law situation will be analyzed critically in connection with an issue regarding which there are very differing views. For this purpose, the legal basis of the manner to acquire the property through private sale and purchase and through public auction will be examined and subsequently, a proposal will be made on the moment of the transfer that helps to provide legal certainty to the treatment of the problem.
