    The comparison between two recent decisions, released by the CGEU in December 2020, points out the existence of two different spheres of cooperation, the EAW one and the EIO one. Both rooted into the principle of mutual recognition, the two ambitious instruments of advanced cooperation are based on different features, in the text, in the context and in the purposes, of EAW and EIO. For these reasons, the autonomous concept of ‘issuing authority’ has different meanings under the two spheres, with no risk of inconsistency

    Nel raffronto tra due sentenze pronunciate nel dicembre 2020 dalla Corte di giustizia emerge in termini chiari la duplicità dei sistemi in cui si inseriscono, rispettivamente, MAE e OEI. Entrambi strumenti d’avanguardia della cooperazione giudiziaria infraeuropea, espressione più autentica del principio del mutuo riconoscimento, essi costituiscono tuttavia, sistemi differenziati all’interno dei quali la nozione autonoma di autorità giudiziaria emittente deve assumere connotazioni diverse, per ragioni testuali, contestuali e finalistiche.
