Resumen de La acción constitucional para proteger el derecho a la seguridad social

  Dentro del presente trabajo se habrá de tratar: “La acción constitucional para proteger el derecho a la seguridad social.” Puesto que, a pesar de que la seguridad social se halla garantizada en Ecuador, en la práctica se presentan problemas en su ejercicio, como es el caso de reducir intencionalmente el pago que corresponde por jubilación, con la clara intención de eludir la responsabilidad patronal. Otra experiencia ecuatoriana que debe referirse, es que las instituciones de la seguridad social se resistan a prestar el servicio hospitalario que se debe por ley a la familia del asegurado. Ante estos eventos, ha sido necesario que la Corte Constitucional emita sentencias que compelan a cumplir con la seguridad social, por lo que este trabajo referirá a la experiencia que existe sobre esta materia. La metodología a ser utilizada en la investigación es deductiva, exploratoria y descriptiva. Se utilizará un enfoque cualitativo, por ser el propio de las ciencias sociales y más puntualmente del Derecho.

  Within the present work we will have to deal with: "The constitutional action to protect the right to social security." Due to the fact that social security is guaranteed in Ecuador, in practice there are problems in its exercise, as it is the case of intentionally reducing the payment corresponding to retirement, with the clear intention of avoiding employer responsibility. Another Ecuadorian experience that should be mentioned is that the social security institutions are reluctant to provide the hospital service that is owed by law to the family of the insured. In the face of these events, it has been necessary for the Constitutional Court to issue sentences compelling compliance with social security, so this work will refer to the experience that exists on this matter.

  The methodology to be used in the research is deductive, exploratory and descriptive. A qualitative approach will be used, as it is the one of the social sciences and more punctually of the Law.
