    The Policing and Crime Act 2017 has innovated the English precautionary system in some salient points to reduce the abuse of the pre-charge bail (PCB). Nevertheless, a few years after its approval, unexpected problems appeared due to the misuse of the release under investigation (RUI), so much so that the Home Office, following the government consultation in 2020, has already expressed its intention to reform the pre-charge bail once again.

    Con l'entrata in vigore del Policing and Crime Act 2017, il sistema cautelare inglese è stato innovato in alcuni punti salienti del tanto abusato istituto del pre-charge bail (PCB). A distanza di qualche anno dalla sua approvazione, però, si stanno affrontando inedite e impreviste problematiche legate ad un abuso del contrapposto istituto del release under investigation (RUI) a discapito del pre-charge bail, tanto che l'Home Office, a seguito della consultazione governativa del 2020, ha già manifestato l'intenzione di riformare nuovamente l'istituto del pre-charge bail.
