Los títulos valores contienen un derecho autónomo, pero no surgen sin tener causa. La “relación causal”, y el propio título valor, coexisten. Sin embargo, concepciones erradas sobre la autonomía del título valor podrían inducir al error de creer que la coexistencia de ambos llegase a generar duplicidad de obligaciones de pago para el deudor. Este artículo analiza el acercamiento de Perú y Colombia a este problema, en contraste con la falta de regulación precisa de Bolivia

Securities contain an autonomous right, but they do not emerge without having a cause. The “underlying relationship” of the security, and the security itself, coexist. However, misconceptions about the autonomy of the obligations under the security could lead to the mistaken belief that coexistence of both generates a duplication of obligations for the debtor. This article analyses the approach of Peru and Colombia to this problem, in contrast with the lack of precise regulation in Bolivia.
