    El presente comentario tiene por objeto analizar la reciente STC 73/2021, de 18 de marzo, y abordar el estado actual del incidente de nulidad de actuaciones para reafirmar que se trata de un remedio procesal artificioso y que únicamente entorpece al ciudadano en materia de protección de los derechos fundamentales. Por tanto, defender planteamientos formalistas alrededor del incidente de nulidad de actuaciones es contrario a la tutela eficaz y efectiva de los derechos fundamentales.

    The purpose of this commentary is to analyze the recent STC 73/2021, of March 18, and to address the current state of the incident of nullity of actions to reaffirm that it is an artificial procedural remedy and that it only hinders the citizen in the protection of fundamental rights. Therefore, defending formalistic approaches to the incident of nullity of actions is contrary to the efficient and effective protection of fundamental rights.
