Resumen de Legítima y libertad de testar en el derecho civil español

  La libertad de testar es un concepto jurídico que está en la base del Derecho desucesiones y que consiste en la libertad que tienen las personas para poderdeterminar el destino, en el momento de su muerte, del patrimonio que hanformado a lo largo de su existencia. Dicha libertad queda consagrada por laConstitución Española, en su artículo 33 garantiza el derecho a la herencia y ala propiedad privada. Sin embargo, como ha señalado el Tribunal Supremo deforma reiterada en sus sentencias, aunque el principio de libertad de testarinspira nuestra legislación, no es una libertad absoluta, ya que debe sometersea las limitaciones establecidas por la ley, y encuentra un límite fundamental,que es la existencia de un sistema de legítimas. Merece, por tanto, una atenciónespecial el estudio de dicho sistema en nuestro ordenamiento jurídico, no sóloen nuestro Código Civil, sino en los diferentes Derechos Forales que tambiénlo componen. Asimismo, se plantea desde algunos ámbitos, una revisión delsistema de legítimas, más restrictiva y por tanto más favorable a la libertad detestar

  The freedom to testify is a legal concept that is at the base of the law ofinheritance and that consists of the freedom that people have to be able todetermine the destination, at the time of their death, of the assets they haveformed throughout their life. This freedom is enshrined in the SpanishConstitution, in its article 33 it guarantees the right to inheritance and privateproperty. However, as the Supreme Court has repeatedly pointed out in itsjudgments, although the principle of freedom to testify inspires our legislation,it is not an absolute freedom, since it must be subject to the limitationsestablished by law, and finds a fundamental limit , which is the existence of alegitimate system. Therefore, the study of this system in our legal systemdeserves special attention, not only in our Civil Code, but in the different ForalRights that also comprise it. Likewise, from some areas, a review of thelegitimate system is proposed, more restrictive and therefore more favorable tothe freedom to testify.
